1. Introduction
Nodify Systems, Inc. (“Nodify,” “we,” “our,” or “us”) respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how we collect, use, disclose, and protect information when you access or use the Nodify account, Nodify Calendar application, our websites, and related services (collectively, the “Services”).
By accessing or using the Services, you acknowledge that your information may be processed as described in this Privacy Policy.
Please read this Privacy Policy and Terms of Use before using Services operated by Nodify Systems, Inc.
If you do not agree with any part of this Privacy Policy or Terms of Use, please do not access or use our Service.
The Service consists of (i) Nodify Account, the licensing and account management platform at account.nodify.io, and (ii) the Nodify Calendar desktop application for Windows, macOS, and Linux.
This Privacy Policy is incorporated into and forms part of the Terms of Use. The entire agreement and severability provisions of the Terms of Use apply to this Privacy Policy.
2. Information We Collect
We may collect Account Information (name, email address, password credentials), Contact Information (name, email address, and optional company name), License and Activation Information, Payment Information, optional Telemetry (Usage Information, Crash Reports, Diagnostic Information), Website Information collected through cookies, and Communications Information when you contact Nodify.
License and Activation Information
To verify license eligibility, enforce activation limits, prevent fraud, maintain account security, and administer Licensed Features, Nodify may collect information relating to software activations, activation timestamps, installation identifiers, device identifiers, operating system information, authentication events, license status, IP addresses, and related technical information.
Update Checks. When the application checks for Updates, it transmits to Nodify the installed application version, operating system and architecture, and update channel. Update checks do not transmit License credentials, calendar events, tasks, notes, or other locally stored user content.
Such information is collected regardless of whether a user elects to participate in optional product analytics or telemetry programs because it is necessary for operation of licensing and security functions.
Contact Information
When you contact us through our contact form, we collect the name and email address you provide and, if you choose to provide it, your company name. Company name is optional; you are not required to provide it to submit the form or to receive a response.
We use this information solely to respond to your inquiry and to keep a record of our correspondence. We do not use Contact Information for marketing, and we do not sell it.
Payment Information
Payments are processed by a third-party service, which acts as a merchant of record under its Managed Payments service. Records such as receipts, tax invoices, payment and refund correspondence, and transaction-level fraud and dispute records are controlled and held by the third-party service, not by Nodify. Nodify does not receive or store full payment card numbers or other complete payment credentials. The only payment-related data Nodify stores is the webhook event the third-party service sends for each order, which may contain the buyer's email address and order metadata; Nodify uses it to process the order event, retry processing on failure, and investigate support cases.
Content Monitoring and Product Analytics
Nodify does not routinely monitor, review, access, or analyze content stored locally within the Nodify Calendar application.
Users may choose to enable the collection of product usage analytics and telemetry. Where enabled, Nodify may collect information regarding how the Service and its features are used in order to improve functionality, user experience, algorithmic scheduling capabilities, product performance, and future product development. Such analytics are collected only with the user's consent where required by applicable law and do not include the contents of calendar events, task descriptions, notes, or other user-generated content unless expressly disclosed and authorized by the user.
Nothing in this Section obligates Nodify to monitor user activity, investigate potential misuse, or review content stored locally on a user's device, and Nodify assumes no responsibility for such content.
3. How We Use Information
We use information to provide and improve the Services, administer accounts, verify licenses, manage activations, process payments, authenticate users, provide support, respond to inquiries you submit through our contact form, improve product performance, develop product functionality, investigate security incidents, comply with legal obligations, send administrative communications, and send the Nodify product newsletter containing information about product updates, new features, and changes to the Service, which you may opt out of at any time. Nodify does not use calendar events, task descriptions, notes, schedules, or other locally stored user content to train machine-learning models or for any other purpose.
Legal Bases for Processing (EEA and UK Users)
Where the General Data Protection Regulation (“GDPR”), the UK GDPR, or similar laws apply, Nodify processes personal information on one or more of the following legal bases:
- Performance of a contract, including providing the Services, administering accounts, managing subscriptions and licenses, processing payments, and providing customer support;
- Legitimate interests, including maintaining security, preventing fraud, enforcing license restrictions, improving the Services, responding to inquiries, keeping users informed about product updates, new features, and changes to the Service through the Nodify product newsletter, subject to your right to opt out, and protecting the rights and interests of Nodify and its users;
- Consent, where users voluntarily enable optional telemetry, product analytics, crash reporting, or other optional features requiring consent;
- Compliance with legal obligations, including accounting, taxation, regulatory compliance, law enforcement requests, and legal proceedings.
4. Sharing of Information
We may share information with service providers, payment processors, legal authorities where required by law, parties involved in business transactions, and others where you provide consent. Nodify does not sell personal information under any circumstances.
5. International Data Transfers
Nodify is headquartered in the United States. Information may be processed, stored, and transferred in the United States and other countries where Nodify or its service providers operate. Where required by law, appropriate safeguards will be implemented for international transfers.
6. Your Choices and Controls
You may update account information through account settings, delete your account through the Services, manage optional telemetry settings, choose whether to submit crash reports, opt out of the Nodify product newsletter using the unsubscribe link included in every newsletter email, and receive required administrative communications necessary for operation of the Services.
7. Your Privacy Rights
Depending on your location and applicable law, you may have certain rights regarding your personal information, including the right to access, correct, update, delete, restrict, or object to certain processing activities, and the right to receive a copy of your personal information in a portable format where technically feasible.
Users located in the EEA, UK, or other jurisdictions with similar privacy laws may also have the right to withdraw consent at any time and to lodge a complaint with a competent supervisory authority.
You may exercise applicable privacy rights through your account settings or by contacting Nodify. We may request additional information to verify your identity before processing a request. Certain rights may be limited where permitted by applicable law, including where information must be retained for legal, security, fraud prevention, licensing, accounting, or contractual purposes, as described in Section 8.
8. Data Retention
Nodify retains personal information for as long as reasonably necessary to provide the Services, maintain user accounts, administer licenses, comply with legal obligations, resolve disputes, enforce agreements, and protect the security and integrity of the Services.
Retention after account deletion
When you delete your account, Nodify will take reasonable steps to delete or anonymize personal information associated with the account, unless retention is required or permitted by applicable law. Certain information may be retained for legitimate business purposes, including fraud prevention, security, legal compliance, tax and accounting requirements, and enforcement of licensing restrictions.
Closing an account deletes your user identity, sessions, authentication methods, verification and reset records, preferences, and administrative access, and removes the association between your account and any license-holder record. Pending checkout work is abandoned and unused activation codes are invalidated.
Licenses and related grants are not deleted when an account is closed. They are retained under a pseudonymous license-holder identifier that is no longer linked to your user identity, so that Nodify can evidence the Licenses it has issued and meet its commercial, legal, security, and audit obligations. Closing an account does not by itself change the standing of a License or the lifecycle of an existing activation.
Information that has been deleted may persist for a limited period in encrypted operational backups and in replicated database infrastructure.
Deletion of an account does not automatically remove calendar data, tasks, schedules, notes, or other content stored locally on a user's device.
9. Security
Nodify implements reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, disclosure, alteration, loss, or destruction.
Security measures may include access controls, encryption, authentication mechanisms, monitoring of security events, secure development practices, and other industry-standard protections appropriate to the nature of the information processed.
No method of electronic transmission, storage, or processing can be guaranteed to be completely secure. Accordingly, Nodify cannot guarantee absolute security and disclaims liability for unauthorized access or events beyond its reasonable control.
10. Third-Party Services
The Services may integrate with or rely upon third-party services, including payment processors, analytics providers, hosting providers, communication providers, and other service providers. For more information please refer to our List of Subprocessors.
Server-side error and diagnostic reports generated by Nodify's own infrastructure are processed on the basis of Nodify's legitimate interest in maintaining the security and reliability of the Services and are separate from optional client-side crash reporting, which remains subject to user choice.
Nodify does not control and is not responsible for the privacy practices, security practices, or content of third-party services. Your use of such services is governed by the applicable third party's terms and privacy policies. We encourage you to review those policies before using such services.
11. Children's Privacy
The Services are not directed to children under the age of 16, and Nodify does not knowingly collect personal information from children under 16.
If Nodify becomes aware that personal information has been collected from a child under 16 without appropriate parental consent, Nodify will take reasonable steps to delete such information as required by applicable law.
Parents or legal guardians who believe that a child has provided personal information to Nodify may contact us using the information provided below.
12. Updates to This Policy
We may update this Privacy Policy occasionally. Any changes that lead to increased use or sharing of your personally identifiable information will be communicated to you through email. We may also make minor updates to this Privacy Policy that do not significantly impact how we handle your personal information, for which we won't send an email notification. We suggest reviewing this page from time to time to stay informed about any updates. If you find any minor updates unacceptable, please contact us immediately and stop using the Nodify Service until the matter is addressed. Continuing to use the Nodify Service after minor updates are posted means you accept those changes.
